Your 401(k), UK Pension or Gulf Gratuity After Moving Back to India

Years abroad usually leave behind more than a bank account: a 401(k) in the US, a workplace pension in the UK, end-of-service gratuity in the Gulf, CPF in Singapore. When you move back, the instinct is to bring everything home and start fresh. Sometimes that is right. Often it is expensive.
This guide sets out what usually happens to each, the questions to ask before acting, and how to put the money that does come home to work. Retirement rules abroad are detailed and change; take specialist help in the country concerned before you withdraw or transfer anything.
Three rules before you touch anything
- Know your Indian tax status for each year. While you are RNOR, income earned abroad is generally outside Indian tax, so timing can matter. Check it with our RNOR calculator.
- Know the other country's rules. Early withdrawal penalties and withholding tax apply whatever India does.
- Think in two currencies. Money that will be spent in India eventually needs to be in rupees; money for a child's studies abroad may not.
US 401(k) and IRA
A 401(k) or IRA can usually stay invested after you leave the US, and you can often roll a 401(k) into an IRA. Withdrawals before age 59½ generally carry an extra US tax on top of income tax, and the US withholds tax on payments to people living abroad.
India has a rule for retirement accounts in some notified countries, including the US, UK and Canada, that can line up when India taxes the income with when it is withdrawn. Whether it helps you is a question for your chartered accountant. If you qualify for US Social Security, payments can generally continue after you move; check the US rules for your case.
UK pensions
Workplace and personal pensions can stay in the UK and be drawn later, from the minimum pension age set by UK rules. Moving a UK pension to India is only possible into a scheme the UK recognises, very few qualify, and a transfer can carry a heavy UK tax charge. A UK-regulated pension specialist should look at it before anything moves.
The UK State Pension can be paid to you in India, but it does not rise each year while you live here.
Gulf gratuity and end-of-service benefits
Gulf countries pay end-of-service gratuity as a lump sum when you leave. In the UAE it is set by the Labour Law and based on your last basic salary; our UAE gratuity calculator estimates it.
The UAE does not tax it, and income earned and received abroad while you are a non-resident is outside Indian tax. Bring it home through normal banking channels. If part of it may be needed in foreign currency later, it can sit in a Resident Foreign Currency (RFC) account; see what happens to your NRI accounts.
Singapore CPF
Foreigners who leave Singapore for good can usually withdraw their CPF savings; permanent residents generally have to give up PR first. Check the current CPF rules and timing before you leave.
Putting lump sums to work in India
- Set aside an emergency fund first: about six months of household costs, somewhere easy to reach. Our emergency fund calculator gives the number.
- Give every other part a goal and a date: a child's education, a home, retirement income.
- Invest in stages. Moving a large sum into markets on one day ties the result to that day; a systematic transfer plan spreads it over months.
- If the money must pay you an income, look at a systematic withdrawal plan. The SWP calculator shows how long a sum could last. Figures are illustrations, not promises.
Worked example
A Gulf family's gratuity, given a plan
Joseph, 52, returns to Goa from Abu Dhabi after fourteen years. His gratuity comes to about AED 120,000, and the couple have savings in the UAE and in India.
Before leaving, they bring the gratuity home through their bank. In India, six months of expenses go into an emergency fund. A part is set aside for their son's final two years of engineering college. The rest is earmarked for retirement income from Joseph's 60th birthday and moved into investments in stages over twelve months.
Joseph is RNOR for his first tax years back. He uses them to decide, with his chartered accountant, what to do with the savings still in the UAE.
Amounts are illustrations. Investments carry market risk and returns are not guaranteed.
How we can help
We help returning families put the money they bring home to work in India, goal by goal, starting on WhatsApp while you are still abroad. Retirement accounts abroad need specialists in that country, and tax questions your chartered accountant; we line up the India side with both. See the returning to India checklist.
Frequently asked questions
It can usually stay invested in the US. Withdrawals before 59½ generally carry an extra US tax, and the US withholds tax on payments to people abroad. India's tax on it depends on your residential status and on a special rule for some countries' retirement accounts; ask your chartered accountant.
Only into a scheme the UK recognises, very few Indian schemes qualify, and a transfer can carry a heavy UK tax charge. Many people leave UK pensions in the UK and draw them later. Take UK-regulated specialist help first.
The UAE does not tax it, and income earned and received abroad while you are a non-resident is outside Indian tax. Confirm the timing for your case with your chartered accountant.
Start with an emergency fund, then give each part a goal and a time frame, and invest in stages. The right mix depends on your goals and comfort with risk; we work it out with you.
Generally yes. FEMA allows assets acquired while you lived abroad to be kept. Once you become an ordinary resident, they must be reported in your Indian return.
